Packwood Grand Contest Rules

THESE CONTEST RULES INCLUDE IMPORTANT TERMS ABOUT YOUR POTENTIAL PARTICIPATION IN THE CONTEST; PLEASE READ AND REVIEW THEM CAREFULLY.

 

KEY DETAILS:  The Mattamy Homes Packwood Contest (the “Contest”) begins August 2, 2023 at 2:00 P.M. MST and ends on August 9, 2023, at 2:00 P.M. MST (the “Contest Period”). There is no purchase necessary to enter this contest.  The contest is being administered and sponsored by Mattamy Homes Limited (the “Sponsor” or “Mattamy Homes”).

 

ELIGIBILITY: The Contest is open only to individuals who: (a) were in attendance at the Packwood Grand event in Calgary, Alberta during July 29-30, 2023 (the “Event”); (b) are legal residents of Canada (excluding Quebec); (c) have reached the legal age of majority in their province/territory of residence at the time of entry; and, (d) have internet access (which can be accessed for free at certain public facilities, for example, public libraries) and an Instagram account (each, an “Account”) (which can be obtained for free by visiting www.instagram.com and following the on-screen instructions to register for a free Instagram Account). Employees, representatives or agents of the Sponsor, its affiliates, subsidiaries, parent and related companies, advertising and promotional agencies, and any other individual(s), entity or entities involved in the development, production, implementation, administration or fulfilment of the Contest (collectively the “Contest Entities”), and the household members of any of the above, are not eligible to participate in the Contest.


ENTRY: To enter the Contest, you must: (a) share one (1) photo of yourself from the Mattamy Homes booth at the Event to your Instagram stories, (b) tag @MattamyHomes in your photo story post, and (c) be or become a “follower” of the official @MattamyHomes Instagram account (NOTE: you can un-follow at any time after the Contest ends without impacting your chances of winning). When all foregoing required steps of the entry process are complete, you will automatically be eligible to earn one (1) entry in the Contest. To be eligible, your Instagram profile must be public all content and materials associated with your entry (collectively, the “Entry Materials”) must: (i) be submitted and received in accordance with these Contest Rules during the Contest Period; (ii) include all required components and materials noted above; (iii) be in accordance with these Contest Rules, including, but not limited to, the specific Participation Requirements listed below; and (iv) be in accordance with the applicable Instagram platform terms, rules, policies and guidelines (the “Social Platform Rules”) (all as determined by the Sponsor in its sole and absolute discretion).

 

All entries must comply with Instagram’s posting requirements, all other applicable platform rules, and the submission requirements set out below in these Contest Rules and must not contain obscene, offensive, or any language communicating messages inconsistent with the positive images to which Sponsor wishes to associate (all as determined by Sponsor in its sole discretion). IF A PHOTO IS POSTED IN ANY MANNER OTHER THAN AS SET FORTH IN THESE CONTEST RULES, IT WILL NOT CONSTITUTE A VALID ENTRY.

 

RESTRICTIONS: Limit one (1) entry per person and per Account. For certainty, every person is permitted to enter the Contest using their Account up to a maximum of one (1) time during the Contest Period. Completing multiple entries using different Accounts is strictly prohibited.  Entry is restricted to natural individuals; corporations, partnerships or other legal entities are not permitted to participate. Any attempt by a participant by using multiple/different accounts, identities, registrations or any other methods will void that participant’s entry and that participant may be disqualified. Entries must be posted and received and identifiable by and viewable to the Sponsor during the Contest Period and at the time of winner selection and prize award for this Contest to be eligible. Sponsor, at its sole discretion, may accept or disqualify an entry that contains content that is: (i) superfluous and/or not truthful to the required content or (ii) otherwise violates these Contest Rules.  Story shares that are not both actually visible and timely received by Sponsor during the Contest Period will not be entered into the Contest.  For purposes of this Contest, stories are “received” when the @MattamyHomes Instagram account is notified of a story tag/mention and it is visible to Sponsor.

 

IMPORTANT: It is each participant’s sole responsibility to timely check his or her Instagram account for any direct messages, direct posts, or @Replies (as applicable) from Sponsor.  Sponsor is not responsible for changes to Instagram (or any website or mobile application offered as part of such platform) or its functionality that may interfere with the Contest or ability of a participant to timely enter or otherwise participate at all.

 

STORIES REPRESENT SOLELY THE VIEWS/OPINIONS OF THE APPLICABLE PROSPECTIVE PARTICIPANT AND DO NOT REFLECT THE VIEWS/OPINIONS OF SPONSOR IN ANY MANNER. SPONSOR IS MERELY REQUESTING PERSONS TO POST PHOTOS AND DISCLAIMS ANY AND ALL LIABILITY IN CONJUNCTION WITH SAME.

 

MOBILE ENTRY:  Message and data rates (and perhaps other charges) may apply to use of mobile device for Contest entry.  You may be charged by your wireless carrier if participating in the Contest via mobile device. It is therefore recommended that you consult your wireless carrier's pricing plan BEFORE participating in the Contest via mobile device. Not all mobile devices offer wireless Internet access; and, wireless Internet access may not be available in all areas.  Sponsor will not be liable for any charges that any person incurs due to the way that they choose to enter the Contest if there is a cost associated with the method of entry.

 

PARTICIPATION REQUIREMENTS: BY PARTICIPATING IN THIS CONTEST, YOU AGREE TO RELEASE THE RELEASED PARTIES FROM ANY AND ALL LIABILITY IN CONNECTION WITH THE CONTEST AND YOUR PARTICIPATION THEREIN AND TO INDEMNIFY THE RELEASED PARTIES AGAINST ANY AND ALL CLAIMS, DAMAGES, LIABILITIES, COSTS, AND EXPENSES ARISING FROM YOUR PARTICIPATION IN THE CONTEST. BY PARTICIPATING IN THIS CONTEST, YOU ALSO AGREE THAT YOUR ENTRY (AND EACH INDIVIDUAL COMPONENT THEREOF – INCLUDING, WITHOUT LIMITATION, THE ENTRY MATERIALS) COMPLIES WITH ALL CONDITIONS STATED IN THESE RULES. THE RELEASED PARTIES WILL BEAR NO LIABILITY WHATSOEVER REGARDING: (I) THE USE OF YOUR ENTRY (OR ANY COMPONENT THEREOF – INCLUDING, WITHOUT LIMITATION, THE ENTRY MATERIALS); (II) PARTICIPATION IN ANY CONTEST-RELATED ACTIVITIES; (III) ANY USE, COLLECTION, STORAGE AND DISCLOSURE OF ANY PERSONAL INFORMATION; AND/OR (IV) IF DECLARED A WINNER, THE PRIZE (INCLUDING ANY USE OR MISUSE OF THE PRIZE). THE RELEASED PARTIES SHALL BE HELD HARMLESS BY YOU IN THE EVENT IT IS DISCOVERED THAT YOU HAVE DEPARTED FROM OR NOT OTHERWISE FULLY COMPLIED WITH ANY OF THESE RULES AND/OR THE SOCIAL PLATFORM RULES (AS APPLICABLE). THIS RELEASE AND INDEMNITY SHALL CONTINUE IN FORCE FOLLOWING THE TERMINATION OF THE CONTEST AND/OR AWARDING OF ANY PRIZE. 

 

By participating in the Contest, each entrant hereby warrants and represents that any Entry Materials he/she submits:

 

1. is/are original to him/her and that the entrant has obtained all necessary rights in and to the Entry Materials for the purposes of entering such Entry Materials in the Contest;

 

2. does not violate any law, statute, ordinance or regulation;

 

3. does not contain any reference to or likeness of any identifiable third parties, unless consent has been obtained from all such individuals and their parent/legal guardian if they are under the age of majority in their jurisdiction of residence;

 

4. will not give rise to any claims whatsoever, including, without limitation, claims of infringement, invasion of privacy or publicity, or infringe on any rights and/or interests of any third party; and

 

5. is/are not defamatory, trade libelous, pornographic or obscene, and further that it will not contain, depict, include, discuss or involve, without limitation, any of the following: nudity; alcohol/drug consumption or smoking; explicit or graphic sexual activity, or sexual innuendo; crude, vulgar or offensive language and/or symbols; derogatory characterizations of any ethnic, racial, sexual, religious or other groups (including, without limitation, any competitors of the Sponsor); that endorses, condones and/or discusses any illegal, inappropriate or risky behaviour or conduct; personal information of individuals, including, without limitation, names, telephone numbers and addresses (physical or electronic); commercial messages, comparisons or solicitations for products or services other than products of the Sponsor; any identifiable third party products, trade-marks, brands and/or logos, other than those of the Sponsor and/or Event; conduct or other activities in violation of these Contest Rules; and/or any other materials that are or could be considered inappropriate, unsuitable or offensive, all as determined by the Sponsor in its sole and absolute discretion.

 

The Sponsor and/or its promotional agency or designated content moderator (the “Reviewer”) reserves the right to screen all Entry Materials.  Any Entry Materials that the Reviewer deems, in its sole and absolute discretion, to violate the terms and conditions set forth in these Rules are subject to disqualification.  The Reviewer reserves the right, in its sole and absolute discretion at any time and for any reason, to remove any Entry Materials (or any part thereof) and/or to request an entrant to modify, edit and/or re-submit his or her Entry Materials (or any part thereof) in order to ensure that the Entry Materials comply with these Rules, or for any other reason. If such an action is necessary at any point during or after the Contest, then the Sponsor reserves the right, in its sole discretion, to take whatever action it deems necessary based on the circumstances – including, without limitation, disqualifying the Entry Materials (and therefore the corresponding Entry and/or the associated entrant) – to help ensure that the Contest is being conducted in accordance with the letter and spirit of these Rules.

 

LICENSE: By entering the Contest and submitting an entry, each entrant: (i) without limiting the Social Platform Rules, as applicable, grants to the Sponsor, in perpetuity, a worldwide, sub-licensable, non-exclusive, license to publish, display, reproduce, modify, edit, make available, communicate to the public by telecommunication and otherwise use his/her Entry Materials (and each component thereof), in whole or in part, for advertising or promoting the Contest or for any other reason in any type of media; (ii) waives all moral rights in and to his/her Entry Materials (and each component thereof) in favour of the Sponsor (and anyone authorized by the Sponsor to use such Entry Materials); and (iii) agrees to release and hold harmless the Released Parties from and against any and all claims, damages, liabilities, costs, and expenses arising from use of his/her Entry Materials (or any component thereof), including, without limitation, any claim based on publicity rights, defamation, invasion of privacy, copyright infringement, trade-mark infringement or any other intellectual property related or other cause of action whatsoever.  

 

PRIZE:  There is one (1) prize available to be won, consisting of two VIP tickets to the Packwood Grand event in 2024. The approximate retail value of the prize is $440 CAD. The prize must be accepted as awarded, in the name of the winner (who must be the person who submitted the entry), is not transferable, and no substitution will be made for the prize except by the Sponsor in its sole discretion. Tickets are subject to all terms and conditions as stated by the applicable issuer.

 

DRAW PROCEDURES AND ODDS OF WINNING: On August 10, 2023 (the “Selection Date”) at 2:30 P.M. MST, in Calgary, Alberta, the Sponsor or its designated representative will conduct a random draw from among all eligible entries received in the Contest  to determine the one (1) selected entrant. The odds of being selected as a potential winner will depend upon the total number of eligible entries received during the Contest Period.

 

NOTIFICATION OF POTENTIAL WINNERS; SKILL-TESTING QUESTION: The one (1) selected entrant will be notified within two (2) business days of the Selection Date via Instagram Direct Message, at the Instagram Account used to submit his or her entry , from the @MattamyHome Instagram Handle.  That person will receive instructions on how to be confirmed as the prize winner, which will include (among other things) a requirement to correctly answer a mathematical skill-testing question without mechanical, computational or other assistance. 

 

CLAIMING PRIZES:  The selected entrant will have thirty (30) days from the date that the first notification message is sent to reply to that message, and their reply must include the correct answer to the skill-testing question, their physical address for mailing the prize, as well as the correct email address to reply to.  If the Sponsor does not receive the correct reply at the correct email address within such 30-day period, if the skill-testing question is not answered correctly, or if any of the Sponsor’s communications are returned as undeliverable, that person will automatically forfeit their prize and the Sponsor reserves the right, in its sole and absolute discretion and time permitting, to select an alternate potential winner in accordance with the procedure outlined above, with the necessary amendments, and the selected backup will be contacted in their place, and this process is repeated with such entrant.  The Sponsor will attempt to contact up to two (2) back-ups, after which the prize will be forfeited. The prize will be sent by mail to the mailing address provided in the response email.

By accepting the prize, the selected entrant: (i) confirms compliance with these Contest Rules; (ii) acknowledges acceptance of the prize as awarded; (iii) releases the Contest Entities and their respective shareholders, directors, officers, employees, agents, successors and assigns (collectively the “Released Parties”) from any and all liability in connection with this Contest, his/her participation therein and/or the awarding and use/misuse of the prize or any portion thereof; and (iv) agrees to the publication, reproduction and/or other use of his/her name, address, voice, statements about the Contest and/or photograph or other likeness without further notice or compensation, in any publicity or advertisement carried out by or on behalf of the Sponsor in any manner or medium whatsoever, including print, broadcast or the internet

As set out below, the Sponsor is not responsible for any lost, misdirected or late communications; all risk of communication is on the entrants.

 

AGREEMENT: By participating in the contest, each person automatically and irrevocably agrees: (i) to be legally bound by these Contest Rules, (ii) to release the Released Parties from any liability whatsoever arising in connection with the Contest no matter what the reason including if the Sponsor has been negligent in any way in the conduct of the contest, (iii) to the use of the person’s personal information for purposes of administering this Contest, and as stated below under the "Personal Information and Privacy" section below,

 

DISPUTE PROCEDURES:  No correspondence will be entered into except with the potential winner. The decision of the Sponsor in respect of any matter related to this Contest (either before or following selection) is final and without appeal. Contest is subject to all applicable federal, provincial, municipal and other applicable laws.

 

ENTRY PROVISIONS; DISCLAIMERS; GENERAL PROVISIONS:

 

All entries become the property of the Sponsor. The Released Parties are not responsible for any entry, a prize-winning notification or the claim for prize, which fails to get entered, is lost, misdirected or which arrives late, as the case may be, whether or not due to the fault of any Sponsor or of any other person or thing and whether or not due to an interrupted or unavailable browser or network server or malfunction, congestion, incompatibility, misconnection or miscommunication, failed or lost computer transmissions, or if the Sponsor's Email/Web site portal is compromised by virus, bugs, unauthorized human or unauthorized non-human intervention, or for any technical malfunction of any telephone network or lines, computer on line systems, servers’ access providers, computer equipment, software failures, or failure of any entry to be received due to technical problems or traffic congestion on the Internet or the Sponsor's web site or other similar technical problems beyond the reasonable control of the Sponsor. Proof of transmission (screenshots) does not constitute proof of delivery.

 

The Sponsor reserves the right to cancel, terminate, modify, amend or suspend the Contest or these Contest Rules, in each case in its sole discretion, including but not limited to fraud, if any of the foregoing technical problems prevents the fair or proper administration of the Contest and if the Sponsor does so, it may re-administer, administer or terminate the Contest in any manner it deems suitable. The Sponsor reserves the right to substitute the prize for another prize of equal value. Sponsor is not responsible for printing or typographical errors in any Contest-related materials.

 

Without in any way limiting anything else in these Contest Rules, the Released Parties will have no liability whatsoever if for any reason the contest is not capable of running as planned due to technical problems, including due to computer virus, bugs, unauthorized tampering, unauthorized intervention, fraud, technical failures, or any other causes. The Sponsor reserves their right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the contest or to be acting in violation of these Contest Rules or otherwise in a disruptive manner. Without in any way limiting anything else in these Contest Rules, the Released Parties shall not be held responsible for any errors or negligence that may arise or occur in connection with the Contest including any damage to an entrant’s computer equipment, mobile device, system, software or any combination thereof, as a result of their participation in this Contest.

 

In the event of a dispute over the identity of the person who submitted an entry, the entry will be deemed to be submitted by the authorized account holder of the e-mail account associated with the Account through which the entry was made. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an internet access provider, on-line service provider, or other organization (e.g. business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. The potential winner may be requested to provide the Sponsor with proof that the potential winner is the authorized account holder of the email address associated with the potentially winning entry. All entries and entrants are subject to verification by Sponsor at any time and for any reason.

 

In these Contest Rules: headings are for convenience and do not inform, define or interpret these contest rules; “or” is not exclusive; and “including”, “such as”, or similar language will be read as if not limiting, whether or not used with phrases such as “but not limited to”.

 

PERSONAL INFORMATION AND PRIVACY:

By entering this Contest, each entrant expressly consents to the Sponsor, its agents and/or representatives, storing, sharing and using the personal information submitted with his/her entry only for the purpose of administering the Contest (and awarding the prize if applicable) and in accordance with the Sponsor’s privacy policy (available at: https://mattamyhomes.com/privacy-policy).This section does not limit any other consent(s) that an individual may provide the Sponsor or others in relation to the collection, use and/or disclosure of their personal information.

 

INSTAGRAM DISCLAIMER:

This Contest is in no way sponsored, endorsed or administered by, or associated with, Instagram. By participating in this Contest, you are acknowledging that you are providing your information to Sponsor and not to Instagram. The information you provide will only be used to administer the Contest in accordance with the Sponsor’s privacy policy. Instagram is completely released of all liability by each entrant in this Contest.  Any questions, comments or complaints regarding the Contest must be directed to the Sponsor and not to Instagram.
